Terms of Service for The Business Allies Connect Program
These Terms of Service (“Terms”) govern your participation in The Business Allies’ Connect Program (“Program”). By submitting an application or participating in the Program, you (“Applicant” or “Participant”) agree to be bound by these Terms. The Business Allies is a native Arizona organization dedicated to helping local businesses.

1. Program Overview
The Connect Program provides free professional photography and website design services to eligible Arizona businesses. The goal of the Program is to help local businesses establish a professional online presence. Participation in the Program is a privilege, not a right, and is offered at the sole discretion of The Business Allies.

2. Eligibility and Application
Eligibility: To be eligible for the Program, you must be a legally registered business physically located in the state of Arizona. The Program primarily targets small businesses and startups.

Application Process: All applicants must complete and submit an application through the official Connect Program application portal. The submission of an application does not guarantee acceptance into the Program. The Business Allies will review applications based on criteria including, but not limited to, the business’s needs, stage of development, community impact, and alignment with our mission. We reserve the right to accept or reject any application for any reason.

3. Services Provided
Services may include:

Photography: A single, professional photography session to capture a pre-determined number of images for your business. This may include product shots, headshots, and/or branding photos.

Website Design: The design and development of a standard, responsive website on a pre-selected platform (e.g., WordPress). This typically includes a limited number of pages (e.g., Home, About, Services, Contact).

The following services are explicitly not included in the Program:

Advanced e-commerce functionality, third-party integrations, or custom coding beyond the standard website platform features.

Domain name registration fees. 

The creation of written content for the website. This is the responsibility of the Participant.

Ongoing marketing, or social media management.

Professional photo printing services or advanced photo editing beyond standard retouching.

4. Participant Obligations
As a Participant, you agree to:

Provide all necessary information and content (e.g., logos, text for the website, etc.) in a timely manner as requested by The Business Allies.

Be available and responsive for scheduled meetings, photo shoots, and design review sessions.

Provide timely feedback and approval on design mockups and photo proofs to ensure the project stays on schedule.

Cover all costs associated with domain registration, and any desired third-party subscriptions.

Failure to fulfill these obligations in a timely fashion may result in the termination of services at the discretion of The Business Allies.

5. Intellectual Property and Usage Rights
Ownership: The Business Allies will own all rights to the final photographs, website design, and any other creative assets generated through this program.

Usage License: We grant your business a limited license to use these images and the website for the sole purpose of your business operations. This license is valid only as long as you are an active participant in the Connect program.

Usage Restrictions: The images and website we create must only be used as we have designed. You are not permitted to download the images from the website for use on social media, in print materials, on another website, or for any other purpose without obtaining specific, written consent from The Business Allies for each instance of use.

Unauthorized Use: If any images generated by The Business Allies are used without our express written permission, a fee of $100 will be charged per image for each unauthorized use. Continued unauthorized use may result in the termination of your license and removal of the images and website.

Portfolio and Promotion: By participating in the Program, you grant The Business Allies a perpetual, worldwide, royalty-free license to use your business name, logo, a summary of the project, and a limited number of the final photos and website design screenshots for promotional purposes, including in our portfolio, on our website, and in marketing materials.

6. Disclaimer and Limitation of Liability
The Business Allies is not a law firm and does not provide legal advice. We strongly recommend that you consult with a legal professional regarding your business’s terms, policies, and contracts.

Disclaimer: All services are provided “as is” and without any warranty of any kind, either express or implied. The Business Allies does not guarantee any specific business outcomes, increased sales, or improved search engine rankings as a result of your participation in the Program.

Limitation of Liability: In no event shall The Business Allies, its employees, or its volunteers be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your participation in the Program.

7. Termination of Services
The Business Allies reserves the right to terminate our services to any Participant at any time, for any reason, including but not limited to, a breach of these Terms, lack of communication, or a failure to cooperate with our team.

8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

By participating in the Connect Program, you acknowledge that you have read, understood, and agreed to these Terms of Service.
